Public Domain Video Question

John asks…

Is it legal to perform classical music of dead composers in a YouTube video?

Is this legal:
I have a school assignment where we have to make a short film. The short film will require an actor to play a few classical pieces from long-dead composers like Debussy and stuff. If I were to post this video on YouTube for sharing, would I be in trouble for copyright?

Is classical music in public domain?
Since the team ourselves will be the performers, we won’t have to pay any royalties to the recording artists.
But is the SCORE in public domain too? Or would I need permission from the publisher?

scottparat answers:

Legal. There is NO COPYRIGHT in the USA on anything published prior to 1923.

Even if you were to play a recording of someone playing classical music, it is not covered under federal copyright if that recording was published in the USA prior to 1972.

For anything made (composed and published) after 1923 it would depend upon the exact circumstances (when it was published, by whom, with or without copyright notice, with or without registration, renewals, etc).

Nancy asks…

Documentation that substantiates certain classical pieces to be in the public domain.?

I’m working on a project and making a video. I want to use my own recording of Satie’s Gymnopedie No. 1. I was told that I needed to present documentation substantiating my claim that the material is public domain.

Where do I find the documentation?

scottparat answers:

Here’s a facsimile of the autograph score, signed off by Satie himself in 1888, three times no less, on pages 4, 7 and 9. That should do the trick… :-))

Anonymous Twitter Question

Mark asks…

My daughter is being bullied on Twitter, they refuse to help & delete.?

My daughter is being cyber-bullied on twitter by someone who has made an anonymous account just to harass her. However everytime we contact the support team, they basically say “touch luck, block them”, but they make several accounts just to make up lies about my daughter and then follow all her friends to draw attention to their pages. My daughter has been crying every day as a result, has become very reluctant to go to school and has even been making herself throw up (I have taken her to a doctor/therapist for treatment.)

Twitter refuse to do anything saying that unless it is a physical threat, they do not mediate content. How can I make them see that words/comments can be just as damaging as physical threats. I am worried my daughter will kill herself as a result of these anonymous bullies and Twitter is showing zero concern/compassion. My daughter is also terrified that these accounts will be on the internet for many years to come. What can I do? I am so lost because Twitter ignore every request to delete cyber bullies.
1. She does have protected tweets, they just message the awful comments to her.
2. She could stop using Twitter, but I am disgusted Twitter would rather support letting bullies keep bullying. Why should she have to stop using Twitter because of bullies That just lets them win.

scottparat answers:

You said, “Why should she have to stop using Twitter because of bullies That just lets them win.”

I agree. It’s really a bummer. But you also said, “I am worried my daughter will kill herself as a result of these anonymous bullies…”

So yeah, it bites that Twitter isn’t taking this seriously, but were it my daughter I would speak to her about the wisdom of not patronizing businesses that don’t cater to their customers’ needs or desires.
Twitter needs decent people to boycott it or at least ignore it.

Her life is worth more than a peep or two.

Website Graphics Backgrounds Question

James asks…

What education background required for Website Developer?

Hi I want to be a website developer and what is the desireable way to get training to become a website developer (the best). College? If so, what degree should I obtain? BS IN CS, BA in CS, MIS, CIS, IT, or etc? If so, would I need to double major in art or minor?

OR

Should I just get an online training or certificate or go to a community college or some other route?

Thank you, serious answers please.

scottparat answers:

It really depends on what you want to do. These days, websites are not just about code, but visual presentation, information, data, and compatibility.

If you wish to be a web developer/coder, then a degree in computer science will likely suit you best.

If you wish to be someone who creates the graphic layout, the font style, the visual feel of the site, then maybe a degree in visual arts and graphics might be best.

If you want to run the company that makes websites, then a CIS degree is better because it offers some computer classes and business classes.

If you really want to know what you need to learn, try and find an internship at a company that does what you want to do. If you can’t find that near you, look for a company that does what you want and ask if they will consider creating an intern position for you.

I do web development and I’ve taken things from my math classes, art classes, business classes, and psychology classes to do my job. Over time, you create this mental toolbox you can draw upon to help you solve your customers problems.

It depends really on your abilities. I work with programmers who can’t draw a straight line and others who can paint a masterpiece but have a hard time doing OO programming. But most importantly, it appears you know that learning takes time and effort.

Good luck to you.

PS. I’d stay away from certification until you finish school or get a job that requires them. In this market(US), only the people selling the training are making any money on certificates.

Helen asks…

How do I make my blog look like my website?

I was able to figure out how to integrate my blog into my existing website. However, I’m having trouble with the coding to make the blog look like the rest of my site. I have a Tab at the top to take you to different pages. If I could get some help with that alone, that would be appreciated. I’m not really familiar with html code, so I don’t really know what I’m looking for. Any help?

scottparat answers:

If you are not familiar with html coding then that makes it a little more difficult to help you because I don’t know how much sense my answer will make.

It’s like, you have usually a primary and then possibly some secondary “page layouts” that set the background imaging and style of your web site. If you want to add a blog then you pick one of your layouts and put all of what you want on the page where it would fit in your layout.

Typical things in the layout are backgrounds and buttons and tables and divisions and graphics that are part of how the site is designed to look. If you don’t at least know enough html to recognize those portions of code on your web page then maybe you should use some web editing software that can help you out.

scottparat answers:

Hey! That sounds really good! Sign me up! Okay, I’m in Canada and can’t take advantage, but it does sound very professional and attractive.. Except that after the part where you say “For a very affordable fee (£230), we can get you in front of your target market; at a lower cost than the alternative marketing methods” After target market, it takes a comma and not a semi colon. But I’m being picky. Good luck to you.

Best Internet Marketing Course Question

Betty asks…

Does anyone have a GOOD experience with Best Buy Geek Squad?

It seems from repeated experience that the only thing Geek Squad can do for any problem (except maybe a cracked screen) is to reformat the hard drive & reinstall the operating system.

I took my laptop in for the “Free” Windows 7 upgrade – $40 install charge, no problem. They had it over a week, and NOW… Despite selling me Kaspersky Internet Security (as the “best” anti-virus on the market) they tell me there are 44 viruses on the hard drive. Yes, it’s automatically updated and does daily and real-time scans. Maybe 1 or 2 viruses could even sneak past Kaspersky, but 44??

Now they want $170 to clean the viruses before they can do the upgrade. So they’re charging over $200 for the “free” Windows 7 upgrade. Of course, they tell me they can WIPE THE HARD DRIVE (surprise!) and then do the upgrade for $40 (any idiot could do that).

I have a second computer eligible for the “free” upgrade but I’m not sure I want the Geek Squad to get their hands on it. Do you think it’s Best Buy or Microsoft that is incompetent and/or dishonest? Vista didn’t do a lot for my confidence in Microsoft, and this upgrade fiasco with Best Buy makes me seriously doubt their competence and/or integrity.

What would you do? Pay the $210 + tax, stay with (yech) Vista, or let them wipe the hard drive, and spend several days reinstalling programs and settings?
I’m getting some great answers. Thanks, folks. Keep ‘em coming!

scottparat answers:

Sorry. You got took. Kapersky is invasive and slows down your pc almost as bad as a virus will. AVG has an excellent security system free to download.. They come higly recommended. No , best buy has publicly admitted that their geek squad is a farce. They have no special training. Look, the upgrade is a cinch. I believe you can do it. I did . Worst scenario is you screw up and have to take it some where BUT…if you do…call another company. Not geek squad. And take the spyware off yourself, first. Oh…Trend-Micro is the bomb in security(they rawk)…And they will scan your pc from online…sweet. Here

http://housecall.trendmicro.com/

they also have a free set of downloads that work.

Blogger Themes Html Question

Ken asks…

I want to start a bog but I need to be able to create one with a pdf archive. Any idea how this can be done?

George asks…

How much it takes to learn everything about html and css to build a site and make blog themes?

scottparat answers:

HTML is very easy. CSS is not as easy. You can download free blog themes from places like:

http://www.bloggertemplatesfree.com/ — For Blogger
http://www.freewpblogthemes.com/ — For WordPress
http://www.freewebsitetemplates.com/ — For Anything
http://freesitetemplates.com/ — For Anything
http://www.template4all.com/ — For anything

Using these doesn’t require a lot of HTML or css at all. You can also use programs such as:
dreamweaver (pc and mac)
visual web designer (pc)
rapidweaver (mac)

There are also websites to help teach yourself web design:
http://www.w3schools.com/html/default.asp — HTML
http://www.htmlcodetutorial.com/ — HTML Help
http://www.w3schools.com/css/default.asp — CSS

It doesn’t take long to learn these skills, took me about three months to have some pretty awesome websites.

You can also use validators to check and make sure your code is accurate:

http://jigsaw.w3.org/css-validator/ — CSS
http://validator.w3.org/ — HTML

As you get more advanced there are many more options for coding you can implement:
PHP
Java
SQL / MySQL
and some others. Hope I helped.

Public Domain Christmas Songs Question

Joseph asks…

who originally composed and sing the Christmas song ” Silent Night O Holy Night”?

christmas song

scottparat answers:

Here is what I found

Silent Night” (“Stille Nacht”) is a popular Christmas carol. The original lyrics of the song Stille Nacht were written in German by the Austrian priest Father Josef Mohr and the melody was composed by the Austrian headmaster Franz Xaver Gruber. The version of the melody that is generally sung today differs slightly (particularly in the final strain) from Gruber’s original. Today, the lyrics and melody are in the public domain.

Maria asks…

Does it cost money to…?

Does it cost money to make a recording of you singing a christmas song, then selling the CD if the chrsitmas song isnt under copyright? If it is, then how would i ask for permission, and how much does it cost??? Thx!

scottparat answers:

If the song is in the public domain (no longer copyrighted), then you don’t have to pay anyone for using the song. But if it is copyrighted, then you need to get permission from who ever owns the rights to the song. You also may or may not have to pay a royalty on it (a percentage of the profit made from each CD sold).
